- Design
There are two types of design rights: registered design rights and unregistered design rights. Registered designs protect the aesthetic qualities of a product whereas unregistered design rights protects the functional aspects of a design.
- Disclaimer
Elements within a trade mark which should not be owned by any party may be voluntarily disclaimed by applicant to help ensure grant. No rights subsist in relation to a disclaimed element.
- Division/merger
A trade mark application may be divided into one or more separate applications by the applicant at its discretion. The applicant may choose to do this if the application is facing objections in relation to only part of the specification. Divided applications can later be merged together.
- Duration
A registered trade mark is for a period of 10 years from the grant date and may be renewed for subsequent periods of 10 years.
