- Search
This is an essential step to ensure an intended trade mark is free to use and free to register. It is recommended that no trade mark is used until a thorough search of the Register has been performed to identify any identical or confusingly similar registered trade marks. As the register does not include unregistered trade marks, reasonable enquiries should be made through trade journals to see if an intended mark is in use in relation to identical or similar goods or services.
- Security interest
A registrable transaction to record a legal interest a party may have to a trade mark owned by another. Such interests are most commonly recorded in relation to loans that may have been secured against a registered trade mark and offer certain protections to the party with the interest.
- Series of trade marks
It is possible for an application for a trade mark to contain a number of trade marks as long as those marks are materially similar; ie, use of different fonts.

Class 43: Services for providing food and drink; temporary accommodation.
Class 44: Medical services; veterinary services; hygienic and beauty care for human beings or animals; agriculture, horticulture and forestry services;
Class 45: Personal and social services rendered by others to meet the needs of individuals; security services for the protection of property and individuals.
- Specification
Another name for classification of goods or services covered by a trade mark.
- Statutory declaration
A document used to provide the evidence of a party in relation to proceedings before the UK-IPO and is authenticated before a notary public.
- Surrender
A voluntary step the owner of a registered trade mark may take to either cancel his trade mark in full or in relation to certain goods or services in the specification. Such steps usually occur when a registered trade mark is threatened with revocation.
