Qualified Trade Mark Attorney

Our client, a bohemian private practice, needs an artisan Trade Mark Attorney for their London office.

You’ll be very creative – an ideas person, with your own sense of direction.

Ideally you will be up for the challenge of developing a client portfolio beyond what already exists, working with a Trade Mark Partner in business development and networking. We anticipate that you will be a UK qualified Trade Mark Attorney with some experience under your belt (as a guide perhaps 2-5 years but don’t rule yourself out unnecessarily). Trade Mark Attorney – minimum of three years qualified

Job Profile
Mishcon de Reya is looking to hire a Trade Mark Attorney with proven experience in UK, CTM and international trade mark portfolio management to take on a demanding role within our trade mark prosecution team. Ideal candidates will be able to handle a significant workload and work closely to support the wider Trade Mark Team.

  • Trade mark portfolio management with strategic cost advice to achieve optimum portfolios
  • Search and clearance to use and/or register new marks at the UK and CTM levels
  • Co-ordinate filings and renewals globally via the team’s international associates
  • Provide strategic guidance on trade mark and design applications
  • Deal with registry objections, oppositions, revocations and associated coexistence agreements
  • Manage prosecution deadlines carefully and well in advance
  • Handle high-profile brands with care, skill and attention to detail
  • Provide day to day supervision for a growing team of attorneys
  • Work closely with the Head of Trade Marks in developing new client relationships and managing existing client relationships

Candidates will be considered from either private practice or in-house but must possess solid experience in the Firm's core sectors as well as in trade mark prosecution. We are looking for an energetic, enthusiastic, driven but team-orientated individual who can demonstrate through past experience and from interview that they have a strong commercial and client-led approach to their work. Must be able to take a swift, analytical approach to client problems, possess solid communication skills and have a sound understanding of the significance of processes in prosecution matter.

The role requires a high level of organisation, with excellent attention to detail and ability to prioritise a range of competing tasks. Proven experience of working in a Trade Marks environment and supporting a team are essential.

Main Responsibilities/Duties
The main Trade Mark-related duties include, but are not limited to:

  • Completing Trade Mark-related forms, certificates and other case-related documentation
  • Working with the Attorneys and the firm's Trade Mark formalities team to produce standard letters such as filing reports, advertisements and registration certificate dispatch letters
  • Audio-transcription and typing of letters, faxes, memos and other documents
  • Answering incoming telephone calls for the team's Trade Mark Attorneys
  • Ensuring all physical files are maintained and up to date
  • Ensuring all relevant correspondence is logged on the firm's Document Management System to maintain the corresponding electronic files
  • Setting up physical file and internal clients records
  • Having an understanding of all current cases within the team and be pro-active to provide support to each fee earner
  • Knowledge Management –providing support to the department's Professional Support Lawyers as and when required and carrying out research when required
  • To work under pressure to meet deadlines with a flexible attitude to working overtime and adjusting working hours when required

The main administrative duties include, but are not limited to:

  • MQ2 administration – file opening and closing, retainer letters and conflict checks
  • Liaising with clients in a timely, professional and courteous manner
  • Preparation of monthly bills and understanding of billing process and compliance
  • Co-ordinating and managing multiple diaries and appointments, including booking rooms, lunches, taxis and other tasks as and when required
  • Preparing and sending emails to include attaching documents, printing and filing of incoming emails, attachments and confirmations
  • Photocopying, faxing, archiving and filing
  • Liaising with other departments
  • Maintaining client contact details on the internal database
  • Maintaining confidentiality in respect of those matters which are commercially sensitive or secret and only share them with colleagues and others on a need to know basis who are themselves bound by an obligation of confidentiality
  • Working with other secretaries/paralegals in the wider Department with a view to providing holiday, illness and other necessary cover to agreed standards

Skills, Experience, Attributes

  • Proven experience of working in a Trade Mark Department and providing a dedicated and tailored support to a number of fee earners
  • Deep understanding of how a Trade Mark Department operates with the ability to add value to the team
  • Supporting qualification desirable but not essential
  • Excellent organisational skills and ability to prioritise and work towards multiple and often conflicting deadlines
  • Dynamic and driven individual with initiative and a ‘can-do’ attitude
  • Excellent attention to detail
  • Effective oral and written communication skills
  • Ability to work well under pressure
  • Excellent team-working skills
  • Good research skills
  • Good IT skills: thorough working knowledge of Microsoft Word, Excel, Internet Explorer
  • Genuine interest in this area of law is desirable.

This role will initially be on a fixed term contract for nine months with a potential opportunity to be made permanent.

Europe Trademark Counsel

Location: United Kingdom - Surrey - Richmond - Pepsico International Limited - TW9 2QL

PepsiCo is looking for an experienced Trademark lawyer to support PepsiCo’s Europe Sector and lead PepsiCo’s trademark work in Europe.  

  • The ideal candidate will be a solicitor qualified in England and Wales with substantial experience practicing trademark law in the UK specifically, and more broadly in the EU.
  • In addition, the ideal candidate will have significant experience searching and clearing trademarks in the UK and EU, prosecuting applications before the UK Trademark Office and OHIM and managing conflicts in the UK and EU.
  • The successful applicant will also have in-depth knowledge of UK and EU trademark law and extensive experience with licensing, domain names, and managing a client’s entire trademark portfolio.
  • Both law firm and in-house experience are preferred.
  • The position seeks someone who is proactive in advising clients, is organized and able to manage a heavy work-load. The candidate should also function effectively as a business partner and team member.
  • The Europe Trademark Counsel will be a member of the trademark team reporting to the VP, Chief Trademark Counsel for PepsiCo and will form part of PepsiCo’s UK based law department, where the position will be located.

Responsibilities in the UK and EU are as follows:

  • Conducting high volume of trademark clearance searches and providing availability opinions;
  • Counseling business colleagues regularly on trademark and trademark related issues;
  • Prosecuting trademark applications (responding to office actions, etc.);
  • Leading oppositions and cancellation actions;
  • Managing trademark litigation matters;
  • Preparing license agreements and analyzing licensing structures;
  • Overseeing domain name issues;
  • Negotiating various agreements, including settlement agreements, consents, co-existence agreements, etc.;
  • Handling intellectual property aspects of business transactions;
  • Working with other members of the trademark team, including trademark attorneys, legal assistants and other team members;
  • Educating marketing colleagues on trademark policies and procedures.
