European Trade Mark Attorney

We are a small, busy, forward thinking practice in York with contacts and clients around the world and are looking for a European Trade Mark attorney to join our team. There are excellent prospects for the right person.  You would be able to handle a full range of work with clients of all types and sizes – based locally and overseas.

Although the ideal candidate would be a full member of ITMA by examination, this is not essential and we would consider candidates who are approaching full qualification or have the MSc in the Management of Intellectual Property and intend to qualify as a MITMA as soon as possible.  Alternatively, we would consider a UK solicitor, or equivalent, with IP experience who would like to qualify as a MITMA.

Those who have language capabilities will be given special consideration and we would also be happy to hear from anyone who wants to move from industry into private practice.

Based in Bournville, Birmingham, you will be an integral part of Cadbury’s Group Intellectual Property Department and work within a team, reporting to the relevant Senior IP Attorney. You will have a strong commercial grounding and business sense as well as wide ranging experience gained across all areas of trade marks and designs from searching and clearance work to the management of oppositions and litigation. With specific responsibility for brands in the Europe region and providing support to business units in Europe, you will file trade marks and designs in the UK/OHIM and instruct overseas agents in the protection and enforcement of our brands. You will also be responsible for reviewing merchandise, product and labelling/packaging, as well as advertising and promotional materials. You will also be involved in ongoing training of the businesses on IP matters, where necessary. Experience in drafting and amending IP agreements and licenses would also be advantageous.

Reporting to the Head of IP Legal our successful candidate will play a key role in implementing the trade mark and other intellectual property related programs for the company. The successful candidate will be responsible for managing 2 full-time IP assistants in delivering all aspects of trade mark prosecution and administration, including reporting on search results, filing trade mark and design applications directly and via overseas advisors, preparing opposition proceedings and attending to renewals.

Our ideal candidate will be a qualified Trade Mark Attorney, Solicitor or dual-qualified Trade Mark Attorney/Solicitor with a minimum of 5 years experience in either private practice an in-house environment.

Excellent written and spoken communication skills will be essential for liaising with representatives of other companies, internal and external counsel. Intellectual Property Counsel

Job Title: Intellectual Property Counsel

Location: Croydon, London

Description: An opportunity has arisen for an Intellectual Property Counsel to join our IP Group at Chanel Ltd.  We are looking for an enthusiastic individual to protect and defend the intellectual property rights ("IPR's") of Chanel Ltd and it's group companies and in the UK overseas.

Key Responsibilities:

  • Clearance and registration of trade marks and designs, including provision of advice to the business teams.
  • Enforcement of rights in relation to bricks and mortar and Internet infringements, including preparation of cease and desist letters; negotiation of settlements; drafting of agreements; preparation of evidence for Oppositions, litigation, and other formal proceedings
  • Managing an anti-counterfeiting programme, including liaison with investigators and enforcement agencies. Presentation of training sessions
  • Contributing to, and implementing, the group IP strategy, policies and procedures

Skills/Experience Required:

  • Qualified to degree level: law degree preferred
  • IP Lawyer, or fully qualified member of ITMA: candidates due to sit final Advanced Paper in November 2008 would be considered
  • A minimum of 4 years’ experience of contentious and non-contentious domestic and international trade mark work essential
  • Excellent negotiating and drafting skills
  • Commercially minded: in-house experience highly desirable
  • Experience of anti-counterfeiting work highly desirable
  • Good computer literacy. Experience of DIAMS database preferred
  • A working understanding of French is helpful, but not essential
  • Excellent written and verbal communication skills. Ability to utilise appropriate styles of working, suited to all levels.
  • Methodical, accurate, with a very high level of attention to detail and presentation
  • Ability to prioritise, and to exercise effective time management and appropriate decision making. Maintain a sense of urgency whilst managing a large case load and numerous deadlines. Willingness to be flexible as the business demands
  • Conscientious, self motivated, and able to work on own initiative, as well as operating within the small local team and within the larger global environment
  • Professional and well-groomed appearance
