Your use of this Site is subject to these terms and conditions and by using the Site you confirm your agreement to such terms. If you do not accept the terms and conditions, please do not use the Site.

This website is owned and operated by ITMA, a company limited by guarantee, with company registration number? and VAT registration number ?, whose registered office is located at Canterbury House, 2-6 Sydenham Road, Croyden, Surrey CR0 9XE. All references to "ITMA", "we", "us" and "our" shall be construed accordingly.

2. Disclaimers

This Site is provided to you free of charge, without any warranties or guarantees unless specifically stated. All material included in our website is intended for information purposes only and does not represent legal advice. You are hereby placed under notice that they should take appropriate precautions to verify such information. You should not act or refrain from acting on the information contained in this Site without first verifying the information and obtaining legal and/or professional advice.

In no event will ITMA be liable (whether in contract or tort (including negligence or breach of statutory duty) or otherwise) for any losses sustained and arising out of or in connection with use or inability to use this Site including, without limitation, loss of profits, loss of data or loss of goodwill (in all these cases whether direct or indirect) nor any indirect, economic, consequential or special loss.

ITMA makes no representations or warranties whatsoever as to the accuracy or completeness, and shall accept no liability for the accuracy or completeness of the information contained in this Site or for any reliance placed by any person on the information.

You agree that material downloaded or otherwise accessed through the use of this Site is obtained entirely at your own risk and that you will be entirely responsible for any resulting damage to software or computer systems and/or any resulting loss of data even if ITMA has been advised of the possibility of such damage.

ITMA does not accept any liability in connection with any third-party websites that can be accessed through this website and does not endorse or approve the contents of any such site.

Nothing in these terms and conditions shall exclude or limit ITMA's liability for fraud, for death or personal injury caused by its negligence, or for any other liability which cannot be excluded or limited under applicable law.

3. Intellectual Property

Except where expressly stated to the contrary, the text and graphics and the information contained in the Site is the copyright of ITMA or our licencees. Reproduction of part or all of the contents in any form is prohibited other than as set out below: (i) you may print or download to a local hard disk selected extracts from these pages for your personal use only; (ii) you may also copy information contained on these pages to individual third parties for their personal information only, but only if: (a) you acknowledge the ITMA Site as the source of the material; (b) in addition to the acknowledgement, you must also include a reference to the ITMA website address http://www.itma.org.uk and (c) you inform the third party that these conditions apply to him or her, and that he or she must also comply with them.

The contents of the membership lists contained in the Site may not be reproduced or used for mailing list purposes without the express permission of ITMA. Action may be taken against anyone who does so without permission. Permission may be sought by contacting ITMA.

ITMA, the ITMA logo and the ITMA Globe are trade marks and/or registered designs of ITMA in the United Kingdom and certain other jurisdictions. All other trade marks that appear in ITMA's website are the property of their respective owners and are used solely to refer to those companies' goods and services.

4. Restricted Access

Access to certain areas of the Site are restricted to ITMA's members.

If ITMA provides you with a user ID and password to enable you to access restricted areas of the Site, you must ensure that the user ID and password is kept confidential. You accept responsibility for all activities that occur under your user ID or password.

ITMA may disable your user ID and password at its sole discretion or if you breach any of the policies or terms governing your use of the Site or any other obligations you owe to us.

5. Amendments

ITMA may amend this privacy policy from time to time and any such amendments will be promptly posted on the Site.

6. Entire Agreement and Order of Precedence

These terms and conditions together with our Privacy Policy constitute the entire agreement between you and ITMA in relation to your use of the Site, and supersede all previous agreements in respect of your use of the Site.

In the event of any inconsistencies between these terms and conditions and the Privacy Policy, theses terms and conditions shall prevail.

7. Law and jurisdiction

These terms and conditions and the content of the Site are governed by English law whose courts shall have exclusive jurisdiction.

B. Orders

8. Process

ITMA may make certain events available for booking and payment online through the Site. Any order to make a booking through the Site can either be paid for at the time of booking or by the posting of a cheque to ITMA's registered office. The booking process is as follows:

Online Payment

You will place an order to book attendance at an ITMA event. ITMA will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to book attendance at an ITMA event which is accepted by ITMA when it sends an e-mail confirming your booking and the allocation of the required number of tickets (the "Booking Confirmation E-mail"). That acceptance will be complete at the time ITMA sends the Booking Confirmation E-mail to you. If ITMA are unable to accept your offer in full or partially, it shall promptly notify you and refund any payment you may made. Depending on the nature of the event, tickets will either by dispatched to you by first class mail or a reservation will be made for you at the relevant event. Please note that online bookings have priority over postal bookings.

Postal Payment

You will place an order to book attendance at an ITMA event. ITMA will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to book attendance at an ITMA event which will only be accepted by ITMA upon receipt of a valid cheque or bankers' draft no later than 7 days from the date of the order, unless otherwise agreed by ITMA. Upon receipt of such a cheque or bankers' draft, ITMA will  send an e-mail confirming your booking and the allocation of the required number of tickets (the "Booking Confirmation E-mail"). That acceptance will be complete at the time ITMA sends the Booking Confirmation E-mail to you. If ITMA are unable to accept your offer in full or partially, it shall promptly notify you and refund any payment you may made. Depending on the nature of the event, tickets will either by dispatched to you by first class mail or a reservation will be made for you at the relevant event. 9. Cancellation of Orders and Liability

You shall have the right to cancel any booking made in accordance with these Terms and Conditions within fourteen working days from the date of the Booking Confirmation E-mail.

ITMA shall effect a refund of any monies owing to the consumer in respect of the bookings within 30 days from the date of cancellation, minus a 20% administration charge.

A consumer is required to notify the ITMA, in writing, of any shortage, miss delivery or other discrepancy immediately, or at the latest within five days of such failure, thereafter the buyer shall be liable for any such discrepancy.

In the event that ITMA cancels any event for which a booking has been made, your sole recourse and ITMA's sole liability to you for such cancellation shall be limited to refunding the amount paid by you (and received by ITMA) for the booking. ITMA shall promptly notify you of any such cancellation and arrange for the refund of the booking payment.

10. Errors

ITMA reserves the right to amend technical or clerical errors in any order without notice. In addition, you shall ensure that all details contained within the order are correct and no liability for any error or inaccuracy shall lie with ITMA.

11. Prices and Delivery Costs

All prices for events on the Site shall mean the consideration due for purchase and shall include VAT and postal costs unless otherwise stated.

12. Force Majeur

ITMA accepts no liability in respect of failure to supply or other interruptions caused by matters beyond the reasonable control of ITMA, including strikes, lockouts, civil disputes, acts of God, war or actions by third parties.
